Definitions
“Agreement” means the terms and conditions contained herein, together with any quotation, order, invoice or other document or amendments expressed to be supplemental to this Agreement.
“Business” refers to Nikoletta Barillo trading as Rent Some Fun.
"Equipment" means Equipment as defined on the Invoice.

Equipment Rental Agreement
The Hirer enters into a contract and agrees and accepts the terms and conditions from the date they make a booking with the Business.

Credit Card Pre-Authorization
By entering into this Agreement with the Business, the Hirer acknowledge and agree that the day before their event, a pre-authorisation will be placed on the credit card provided during the booking process. This pre-authorisation is intended to cover any potential charges for damages to the rented equipment or fees associated with excessive cleaning requirements. The amount of the pre-authorisation will be determined by the Business and specified on the invoice, and is subject to change based on the type and value of the rented equipment. The pre-authorisation will be held for a specified period and will only be charged if damages or cleaning fees are incurred, at which point the Hirer will be notified of the charges. The Hirer responsible for ensuring the availability of sufficient credit limit on the pre-authorised credit card to cover any potential charges. The Business will make reasonable efforts to release the pre-authorisation as promptly as possible upon equipment return in acceptable condition, usually within 7 days, but the timing of the release may vary based on the customer's credit card issuer policies.

Supported Payment Methods
The company/and or person who has made the booking is liable for all payment. Payment will be required before the event via EFT or credit card.

The Business will request credit card details to cover for any damages, theft, cancellations, cleaning or inability to access the Equipment to be picked up at the agreed time. By making a booking, you authorise for your credit card to be charged in the case that any Equipment is lost, stolen, damaged, requires cleaning if a booking is cancelled or is unable to be picked up at the agreed time.

Cancellations
In the event that you decide to cancel your booking, you need to notify us immediately in writing. A cancellation fee will be payable:

- more than 7 days before the hire period commences: $50 (the non-refundable deposit you have paid);
- between 1 and 7 days before the hire period commences: $100;
- less than 24 hours before the hire period commences: 100% of the booking fee, and where a balance payable is due, those funds become immediately payable.

If items are removed from an order or quantities reduced, a cancellation fee will also apply to these items at 50% for items cancelled outside of a 24-hour period of the event date and 100% inside a 24-hour period of the event date.

Cancelled bookings as a result of Covid-19 restrictions still apply.

Rescheduling an event incurs no fees if advising us with 48 hours or more notice. Otherwise a $50 reschedule fee will be payable. By providing your credit card details, you give permission for the Business to charge the supplied credit card for any cancelled or rescheduled bookings.

The Business reserves the right to reschedule a booking if it is a safety risk to deliver or set up Equipment, in the case of extreme weather conditions such as torrential rains, hail, strong winds, flooding, extreme thunderstorms, earthquake or an area being restricted from access due to a terrorist attack. Should we not be able to deliver at a later time on the event date, we will happily deliver on the next available day.

Hiring Period
The hire is for one day unless agreed upon mutually in writing by both parties. Failure to return the Equipment or inability for our drivers to access the Equipment for pick up at the agreed time will incur a daily charge for the Equipment for any days beyond the agreed hire period. This and any additional charges incurred may be charged to the supplied credit card or captured from the pre-authorised amount on hold. If the Hirer fails to return the Equipment, the Hirer gives us permission to enter the premises of where the Equipment is held to collect the Equipment without being responsible for any damages caused to enter the premises.

Loss and Damage
The Hirer accepts full responsibility for the Equipment once they take possession of the Equipment. This is from the time it is delivered, to the time it is collected. In the case that the driver is held up on the day and will not make the scheduled pick up time, you are still liable for it till the time the driver arrives. The Hirer is liable for the replacement cost of any Equipment that is stolen, goes missing, is vandalised or broken. The Hirer is liable for any damages caused to the Equipment, and this includes damages caused by weather and vandalism. In the event that Equipment is heavily dirtied during the hire, we reserve the right to charge a cleaning fee to clean the Equipment, payable by the supplied credit card.

Delivery and Collection of Equipment
The delivery of Equipment will be as specified on the booking invoice. The Hirer is responsible for having someone available to take delivery of the Equipment at the nominated date and time. If the Hirer fails to be there at that time, an additional delivery fee will be charged to re-deliver the Equipment at another time. Delivery and collection is done between the hours of 8am-4pm, seven days a week, excluding public holidays. Should you require a specific time delivery, an additional fee may apply. A time window is set of 4 hours, and your delivery will be allocated to a slot of 8am - 12pm or 12pm - 4pm. This can be provided to you on the week of the event. Deliveries outside of our standard delivery hours of 8am - 4pm may incur an additional fee, please call or email.

Delivery of all Equipment is at ground level only. Extra charges on top of the usual delivery charge apply where the delivery of the Equipment is more than 10 metres away from where our vehicle can park. Extra charges also apply for stairs, steep descents and going up levels in buildings. The Hirer is responsible for telling us via email if the delivery has any of these conditions. Failure to do so will result in extra charges, and in extreme cases refusal to deliver. Extra charges will be payable by the Hirer’s credit card or will be payable on the day in cash.

If, at the agreed time for equipment collection from the Hirer’s specified address, the Hirer is not present and/or the Equipment is not ready for collection, a wait time fee will be incurred. For each 15-minute interval that our team is required to wait, a fee of $20 will be charged. This fee will be automatically billed to the customer's supplied credit card on file or captured from the pre-authorised amount on hold.

Equipment Set-Up
Unless specified otherwise, the Business does not set up the Equipment apart from outdoor cinemas, karaoke machines, and slushie machines. All other Equipment is the responsibility of the Hirer to set up. Instructions can be provided via the phone by calling our office. All Equipment will be placed in a pile for the Hirer to set up in their own time. If you require set up, this service can be offered for an additional hourly rate, but must be pre-booked with our team prior to the delivery date to ensure the extra set up time is factored into our delivery schedule.

Occupational Health and Safety (OH&S)
The Hirer assumes proper knowledge in the operation and handling of the Equipment and follows OH&S policies and does not hold Business responsible for any injury caused to themselves or others whilst moving or setting up any Equipment.

Our team follow strict occupational health and safety processes, procedures and regulations to ensure work ethic is being completed correctly with due care preventing any injury to themselves or any one else.

Should any Hirers request any staff to complete a task that may put them at risk of danger, the staff may refuse to do to so ensuring they comply with QLD state OH&S regulations.

Ownership and Responsibility
The Equipment remains the property of Business at all times. The Hirer may not transfer this contract to another party without written consent of Business.
The Hirer must inspect and check all Equipment and notify Business at the time of delivery if there is any Equipment missing, damaged or unfit for use. Failure to do so will see the Hirer responsible for any damages or missing Equipment upon pick up.
No warranty is provided by the Business for the Equipment’s fitness for any particular use. No responsibility is taken for any damages which may be caused by the hire Equipment. In the event of adverse weather conditions, we take no responsibility if the Equipment cannot be used. In the event that weather damages our Equipment, the customer will be responsible for any damages or losses, payable by the supplied credit card.

Governing Law
The laws of QLD shall govern this Agreement. Venue for any legal proceedings brought in connection with this contract shall be in QLD.

Indemnity
Hirer agrees to defend, indemnify, assume liability for and hold Business harmless from any and all claims, demands, damages, losses, suits, proceedings, penalties, expenses or other liabilities including attorney fees and court costs, arising out of or resulting from the use of the Equipment, regardless of the basis.

Changes to Terms and Conditions
The terms and conditions can only be amended by the Business. Any changes to this contract must be written and signed by both the Hirer and the Business. Oral agreements are non-binding. The latest contract supersedes all previous contracts between the Hirer and the Business. This Agreement binds and benefits the heirs, successors and assignees of the parties.

Enforceability
If any court determines that any provision of this Agreement is invalid or unenforceable, any invalidity or unenforceability will affect only that provision and will not make any other provision of this Agreement invalid or unenforceable and shall be modified, amended or limited only to the extent necessary to render it valid and enforceable.
If one party waives any term or provision of this Agreement at any time, that waiver will only be effective for the specific instance and specific purpose for which the waiver was given. If either party fails to exercise or delays exercising any of its rights or remedies under this Agreement, that party retains the right to enforce that term or provision at a later time.

Customer Injury/Public Liability Insurance
The company has 10 million dollar public liability insurance. Further information regarding our Public Liability Insurance may be provided upon request.
